Personal Injury

Personal Injury claims are filed due to the negligence of someone else. Some of the most common types of personal injury cases include:

  • automobile/truck/motorcycle accidents
  • slip and fall
  • business or home owner negligence
  • products liability
  • work accidents
  • dog bites
  • premise liability
  • homeowner claims
  • dram shop/liquor liability

The insurance laws can be confusing. Did you know that if you’re driving your car and are in an accident with a commercial truck or motorcycle, the laws are different than if you’re in an accident with another private passenger car?

It is also common to assume that the insurance company for the other driver or business owner will cover any medical expenses if a person is in a car accident or falls at a business. This is also not always true. If you’re in an accident of any kind, call our firm to speak with an attorney, who has the knowledge and experience to answer your questions and assist you with your case.

Most personal injury cases are handled on a contingency fee basis, so you pay no fees to us unless we recover compensation for you.

Commercial/Business Transactions

Starting a business is the dream of every entrepreneur; however, what most people do not realize is that it’s not as simple as hanging a sign or placing an ad.

Forming a business entity such as a corporation or LLC is governed by state law, and in addition to understanding the legal requirements of these type of entities, it is also important to know if the particular business you choose is regulated by the state and/or other governmental entity.

For instance, did you know that New Jersey requires all home improvement contractors to register their business with the Dept. of Community Affairs? If you’re a home improvement contractor and fail to do this or even if you have registered but do not understand what is required in your contracts or advertisements, you could be subject to fines, penalties or even criminal charges.

Let us counsel you through the process of forming your business to ensure you comply with the laws. We’ve reviewed and prepared sales contracts, employment contracts and covenants not to compete. We handled litigation matters for commercial clients involving contractual disputes and collection matters. We can help you understand what you’re signing and assist you in preparing a contract for a specific need of your business.

Whether you are a small or large business, we take a proactive approach to protect your business interests.

Wills/Estate Matters

Do you have a Will? Most people think they don’t need one, but chances are you do. If you have a business, a spouse, a child or children, a relative, friend or charity you’d like to help after you pass on or just have assets, then you need a Will.

A Will directs how your assets will be distributed upon your passing. It also directs who you want to have custody of your minor children and who should handle the assets you leave to them. Some people also have a religious institution or other charity that means a lot to them, and they want to leave them some or all of their assets after they pass. You need a Will to accomplish this as well. If you have someone who passed and are confused on how the probate process works, call us. We can help guide you through the administration of an estate as well.

Another issue that may need to be addressed in this context are Living Wills, which involve the withholding or withdrawal of life-sustaining treatment of an individual in the event of an incurable or irreversible condition that will cause death in a relatively short period of time and when such person is unable to make decisions regarding his or her medical treatment. This important document can provide solace to family members burdened with having to make end of life decisions about their loved ones. Having this document state specifically what the individual wants in this horrible situation can certainly provide comfort.

A power of attorney is another important document to consider. A power of attorney is a written instrument that whereby one person, the principal, appoints another as his/her agent to act on the principal’s behalf and confers authority to the agent to perform acts in the name of the principal, such as executing documents, writing checks, etc.

As our family members and friends age or become disabled and consequently become unable to care for their basic needs, having a trusted person who is able to pay their bills and handle other issues on their behalf can be vital. A properly prepared power of attorney can give a person the peace of mind to know that he or she will be cared for when they cannot act for themselves. Some people having been using online or pre-prepared Wills, Living Wills and Power’s of Attorney, but unless you truly know what you’re doing, it can be a nightmare if it’s done incorrectly. Let us answer your questions and guide you through the process of having these documents prepared appropriately. Our firm has been preparing these documents for years and know how to tailor the documents to suit our clients’ specific needs.
